Vendor Terms & Conditions

The following “Terms & Conditions” are applicable to all vendors participating in the Antioch Flea Market. Vendors occupying space at the Antioch Flea Market are responsible for reading and abiding by the terms listed in this document.

1. END OF DAY & TRASH REMOVAL: All spaces must be vacated by 4:00 p.m. each Saturday. Vendors are prohibited from leaving unsold merchandise, boxes, crates, paper, tires and debris of any kind when leaving at the end of the day. There will be no exceptions to this rule. The penalty for the first offense of EITHER of these conditions may be a twenty-five dollar ($25.00) penalty. A second violation of the same offense will result in a fifty dollar ($50.00) penalty. The third violation of the same offense will result in exclusion from future Antioch Flea Market events and loss of their space reservation without refund of any fees that may have been paid in advance.

2. INDEMNIFICATION: Vendor agrees to indemnify and save harmless J.S. Campbell Management its officers, agents, servants and employees from any and all claims, causes of action and suits accruing or resulting from any damages, injury or loss to any person or persons, including all persons to whom the Vendor may be liable under any Workers’ Compensation law and Vendor himself and from any loss, damage, cause of action, claims or suits for damages including, but not limited to, loss of property, goods, wares or merchandise, caused by, arising out of or in any way connected with the exercise by the Vendor of the privileges granted herein.

3. VENDOR LIABILITY: Vendor agrees and understands that J.S. Campbell Management its officers, agents, servants, and employees are not responsible for damage or injury resulting from Vendor’s merchandise or area coverings. It is the Vendor’s responsibility to secure property such as tarps and umbrella’s against natural and/or man-made hazards. THE VENDOR UNDERSTANDS AND AGREES THAT HE/SHE IS LIABLE FOR ANY CLAIMS FROM INJURY OR DAMAGE RESULTING FROM THE VENDORS ACTIONS OR PROPERTY.

4. ALCOHOL: J.S. Campbell Management possesses an on-sale beer license so that adult patrons may enjoy an alcoholic beverage while they enjoy the market. The license is an “on-sale” permit and specifically states that NO OTHER BEER OR ALCOHOL MAY BE BROUGHT ON THE LICENSED AREA (vendor area) and that any alcohol purchased must be consumed within the licensed area before the patron leaves. Any vendor found to have brought beer or any other alcoholic beverage into the vendor area for their own consumption, sale, or give away, will be evicted immediately and will not be given a refund for any fees paid. Vendor will not be allowed to sell at future markets for a period determined by Market Management.

5. PREPARED FOOD: Any Vendor wishing to sell prepared food may not do so without the prior written consent of J.S. Campbell Management. Any vendor receiving approval to sell prepared food MUST have a valid Contra Costa County Health Permit, Valid Resale Number, and an original certificate of insurance indicating current General Liability coverage of no less than $1,000,000 per occurrence naming J.S. Campbell Management as additional insured prior to setting up and selling.

6. LICENSES & PERMITS: It is the Vendor’s responsibility to be aware of any licensing for permits required by City, County and/or State regulatory agencies. All fees and/or taxes are solely the Vendor’s responsibility. Vendor must be able to produce any required documents upon request.

7. COUNTERFEIT MERCHANDISE: No counterfeit, pirated, or stolen property is allowed. J.S. Campbell Management it’s employees and contractors cooperate fully with law enforcement agencies in this regard. Vendors found to selling such items may be excluded from selling for a period determined by Market Management

8. SALES TAX: It is the seller’s responsibility to follow the California Department of Tax and Fee Administration (CDTFA) rules regarding sales tax reporting and payment. Resale Numbers are required from all vendors selling at the Antioch Flea Market more than two times in a 12 month period. Resale permits can be obtained at the CDTFA office located at, 1515 Clay St., Suite 303, Oakland, CA 94612 Phone: (510) 622-4100 or via the Internet at www.cdtfa.ca.gov

9. SUBLEASING/SHARING: Subleasing and/or sharing of a space by any vendor is not permitted.

10. SET UP AND OPERATION: All aisles and walkways must be kept clear and free of trip hazards for pedestrians, and access by service and/or emergency vehicles. Vendor’s equipment must be contained within the booth space rented. This includes pipe from shade coverings, tie down ropes/chains, weights and other canopy equipment. No “A-Frame” signs are allowed to be placed. in the aisle ways. The space identification plaque must be visible and legible at all times.

11. ITEMS NOT ALLOWED: include drugs and drug related paraphernalia, live animals for sale or give-away, pornographic material, weapons of any kind, tasers, and used mattresses.

12. SERVICES NOT ALLOWED: tattooing, ear piercing, hair cutting, and other body work.

13. MUSIC: Music and/or the use of voice amplification devices is not allowed in vendor booths without prior written consent of Antioch Flea Market management.

14. DOGS: For the safety and comfort of all of our guests dogs are not allowed at the Antioch Flea Market.

15. SPACE ID PLAQUES: Space ID plaque must be kept visible and readable to buyers and flea market management during market open hours.

16. FIRE EXTINGUISHERS: All vendors selling more than two times in a twelve month period must have a minimum pressurized type ABC, 5 lb, fire extinguisher with a current valid service tag in their vendor space at all times. The extinguisher must be capable of being refilled and serviceable by a licensed technician annually.

17. FLAME RESISTANT SHADE COVERING: The State of California requires ALL shade covering material used on State property to be compliant with Title 19 of the California Code of Regulations for flame resistance. The State Fire Marshall conducts periodic inspections and has the authority to close any vendor’s operations if they find the coverings being used to be non-compliant.

18. NO SMOKING SIGNS: All vendors are required by the State of California to have “No Smoking” signs visible in their vendor space. The Fire Marshall has determined that vendor spaces with shade coverings are considered “tents” and therefore there is to be no smoking inside or around the tents and applicable signs must be posted to this effect.
